Additional Labeling Terms for Use in California

Application Block: U.S. EPA labels define application block as an "Area within the perimeter of the fumigated portion of a field or greenhouse (including furrows, irrigation ditches, roadways). The perimeter of the application block is the border that connects the outermost edges of total area treated with the fumigant product." For California, an application block is also a field or the portion of a field treated in a 24-hour period that typically is identified by visible indicators, maps, or other tangible means.

Totally Impermeable Film (TIF): A tarpaulin for which permeability test results have been evaluated by both U.S. EPA and DPR, and both agencies have assigned 60% buffer zone credit for chloropicrin fumigations. The tarpaulins approved by both agencies are specified online.

Additional Labeling Requirements for Tarp Perforation and/or Removal in California

Tarps that are identified on the U.S. EPA website as a tarp that qualifies for any buffer zone credit must not be perforated until a minimum of 9 days (216 hours) have elapsed after the application is complete, and must not be removed until a minimum of 1 day (24 hours) after perforation. Tarps may be perforated or removed earlier if label-specified adverse weather conditions have compromised the integrity of the tarp.

Tarps

An application block must only be covered with tarps of the same permeability category. For example, two different brands of TIF may be used in an application block, but an application block cannot be covered with a mix of TIF and other tarps.

For applications using TIF tarps, the certified applicator shall only make the fumigation if the tarp name and lot number are printed on the tarp in a font size equal to 2-3 inches in height and printed at least 1 foot from each edge and at an interval of 20-30 feet along the length of the tarp.

Application Time Restrictions

Applications must start no earlier than one hour after sunrise and must end no later than three hours prior to sunset. For applications using TIF tarps (including products containing methyl bromide and chloropicrin), these time restrictions do not apply.

Additional Labeling Requirements for Buffer Zones in California

Buffer Zone Distances

In place of the buffer zone distances specified by the label, buffer zone distances for California are specified in the following tables. The buffer zone tables include minimum buffer zone distances and maximum application block sizes.

The buffer zone tables specify the distance based on the broadcast-equivalent application rate for the chloropicrin active ingredient (lbs AI/ac). The broadcast-equivalent application rate for the AI is calculated using the same procedure as described on the label for bed/strip width and row spacing, then adjusting for the percent of chloropicrin listed on the label. For example, if the broadcast-equivalent application rate for the product is 300 lbs/ac and the product contains 60% chloropicrin, the broadcast-equivalent application rate for chloropicrin is 300 x 0.60 = 180 lbs AI/ac.

For products containing methyl bromide and chloropicrin, determine the methyl bromide and chloropicrin buffer zones separately and use the largest buffer zone(s).

Buffer Zone Proximity (Overlapping Buffer Zones)

For TIF tarp applications, if buffer zones for two or more applications overlap within 36 hours from the time the earlier application is complete until the start of the later application, combined TIF acreage shall not exceed 60 acres.

For non-TIF tarps or untarped applications using same application method and application rate.

  1. Combined acreage shall not exceed 40 acres.
  2. Buffer distance shall be based on combined acreage of all blocks.

For non-TIF or untarped blocks and blocks using different application methods and/or application rates.

  1. Combined non-TIF/non-tarped acreage shall not exceed 40 acres.
  2. Buffer zone distance shall be based on combined acreage of all blocks using the highest application rate and the buffer table for the method with the largest buffer.

Buffer Zone Credits

There are no buffer zone reduction credits allowed. The buffer zone tables incorporate the 60% reduction for TIF applications.

Additional Labeling Requirements for Emergency Preparedness and Response Measures in California

Fumigant Site Monitoring

The monitoring for sensory irritation must be done along the outside perimeter of the buffer zone.

At the start of each label-specified monitoring period, monitors must determine the wind direction. The wind directions and times of determination must be included in the Post-Application Summary.

Monitoring must be done in at least two different locations along the perimeter, including:

  • Downwind of the application block.
  • In the direction of all residences, businesses, and bystander areas that trigger the Emergency Preparedness and Response Measures.
  • On calm days, monitoring must be done along all buffer zone sides.

The county agricultural commissioner must be notified immediately if the emergency response plan is implemented.

Response Information for Neighbors

If the certified applicator uses Response Information for Neighbors (notification), then it must be in both Spanish and English.
