VOLUME 2 - LAWS AND REGULATIONS, PESTICIDE USE ENFORCEMENT PROGRAM STANDARDS COMPENDIUM

 

The Department of Pesticide Regulation (DPR) has updated Volume 2, Laws and Regulations, of the Pesticide Use Enforcement Program Standards Compendium. 

Laws and Regulations is formatted for ease of use by enforcement staff as an informational tool and is not meant to replace or represent any official record or source. This volume includes the following laws and regulations pertaining to the pesticide regulatory program:

  • Food and Agricultural Code (FAC)
  • Title 3, California Code of Regulations (3CCR)
  • Business and Professions Code (BPC) relative to structural pest control
  • Title 16, California Code of Regulations (16CCR) relative to structural pest control
  • Excerpts of the Labor Code (LC) relative to Farm Labor Contractors
  • Excerpts of the Health and Safety Code (HSC) regarding pesticide poisoning and vector control.

Staff are encouraged to access the officially maintained versions of the appropriate statutes and regulations prior to taking any enforcement action. Links to the official sites are available from DPR's website at: www.cdpr.ca.gov/docs/enforce/compend/vol_2/lawsregs.htm. Copies of the Structural Act, comprised of both the BPC and 16CCR, are available from the Structural Pest Control Board (SPCB), as are regulatory updates via SPCB's website at: www.pestboard.ca.gov/pestlaw/index.shtml

Laws and Regulations has not been updated as consistently as promised in the past. Every effort will be made with the release of this letter to provide regulation updates (Compendium replacement pages) as they are approved, and statutory updates on an annual basis.

A CD containing a complete updated version of Laws and Regulations through August 18, 2008 will be sent to each county in September 2008. The CD will include a summary listing of the updates from the 2006 version of the Food and Agricultural Code, Business and Professions Code, and Titles 3 and 16, California Code of Regulations. Reproductions may be made from the disk.
