UPDATES TO VOLUME 3, RESTRICTED MATERIALS AND PERMITTING, PESTICIDE USE ENFORCEMENT PROGRAM STANDARDS COMPENDIUM, APPENDIX K, CHLOROPICRIN AND CHLOROPICRIN IN COMBINATION WITH OTHER PRODUCTS (FIELD FUMIGANT) RECOMMENDED PERMIT CONDITIONS


This letter describes the availability of updates to recommended permit conditions for Appendix K, Chloropicrin and Chloropicrin in Combination with other Products (Field Fumigant) Recommended Permit Conditions from Pesticide Use Enforcement Program Standards Compendium Volume 3, Restricted Materials and Permitting. These recommended permit conditions replace the previous recommended permit conditions found in Enforcement letter ENF 17-04 dated February 8, 2017. Please note the buffer zone tables remain unchanged. Updates are enclosed and will be available online at the link below. Please have your staff begin using these updates as soon as possible. Hard copies of the updates will not be distributed.

In October 2017, registrants began amending chloropicrin product labels with California-specific use directions. Under the "Directions for Use" section, the amended labels include the header "For Applications in California Only." These California-specific use directions require applicators to follow buffer zone and California restrictions specified at . The California-specific use directions are equivalent to almost all of the recommended permit conditions in Appendix K.

In addition to the California-specific use directions and buffer zone tables specified at the website, DPR recommends the following conditions:

  • Require the notice of intent submitted at least 48 hours before the application (refer to page K-4).
    • Include tree-hole limitations described on page K-15, when applicable.

There may be chloropicrin products in the channels of trade with older labels that do not have label language directing applicators to use California-specific use direction. With these labels, DPR recommends all the permit conditions on pages K-3 through K-40 of Appendix K to ensure that the more restrictive use requirements are applied to all chloropicrin field fumigation applications.

To print the revised portions of the manual, select from the enclosure or go to /www.cdpr.ca.gov/docs/enforce/compend/vol_3/rstrct_mat.htm. It is recommended the sections be printed back-to-back, where applicable. For best results, print appendix separately. Remove the old section from the manual and insert the new section:

  • Table of Contents, pages iii and iv
  • Appendix K, Chloropicrin and Chloropicrin in Combination with other Products (Field Fumigant) Recommended Permit Conditions
