DPR 23-002 Civil Penalty Actions by Commissioners (Noticed 10/6/23; Comment period closed 11/20/23)

DPR amended section 6130 of Title 3, California Code of Regulations. This action increased the fine range for administrative civil penalties levied by county agricultural commissioners from a maximum of $5,000 to a maximum of $15,000 for Class A violations of pesticide use law and from a maximum of $1,000 to a maximum of $3,000 for Class B violations of pesticide use law. These changes are necessary to promote and protect human health and the environment by aligning the existing regulations with certain statutory changes made in Assembly Bill 211 (Stats.2022, ch. 574.), which was enacted by the Legislature and has been effective since September 27, 2022.
