Updates to Compendium Volume 2, Laws and Regulations

This letter announces the availability of and summarizes updates to Volume 2, Laws and Regulations, of the Pesticide Use Enforcement Program Standards Compendium. A table of sections changed in Volume 2 is enclosed. An updated Compendium Volume 2 will be available on the CalPEATS Help Resources page.

Title 3, California Code of Regulations (3 CCR) Updates:

Statewide pesticide application notification system

  • Submit agricultural use notice of intent (NOI) for use of restricted materials via CalAgPermits. In lieu procedures for undue hardship are available.
  • “Specific NOI information” product, time, location, application requirements amended.
  • NOI submission required 48- or 24-hours in advance of intended start of application.
  • DPR to make “Specific NOI information” publicly available upon receipt.

Title 16, California Code of Regulations (16 CCR) Updates:

  • Occupant Fumigation Notice and Pesticide Disclosure form updated.
  • Pre-Application and Post-Application Notice requirements amended.
  • Pesticide information disclosure required within 24 hours upon request.
  • Immediate reporting of death or serious injury to County Agricultural Commissioner in addition to the Structural Pest Control Board (SPCB).

Business and Professions Code (BPC) Updates:

Option for operators, field representatives, and applicators to complete an examination to renew SPCB licenses deleted.

Food and Agricultural Code (FAC) Updates:

Rodenticides: first- and second-generation anticoagulants

  • Updates to definitions, prohibitions, exceptions, and certification requirements.
  • Civil penalties for sale or use in violation of FAC Section 12978.7 provisions of up to $25,000 per violation per day.

Pesticide use within one-quarter mile of schoolsites (see CAC Letter ENF 24-18 for implementation details)

  • Additional requirements as specified for: site ID number, permit, notice of intent, application method, dates/times, and reporting.
  • DPR to evaluate county pesticide use enforcement program effectiveness in enforcing 3 CCR Sections 6690-6692.
  • Regulations to be adopted by 12/31/2026 to apply 3 CCR Sections 6690-6692 to private schools with at least six pupils in grades K-12.
