Updates to Compendium Volume 4, Inspection Procedures

This letter announces the availability of, and summarizes updates to Pesticide Use Enforcement Program Standards Compendium, Volume 4, Inspection Procedures, Chapters 2, 4, 5, 6, 7, 8, 9, and 10. These chapters have been updated to reflect the recent revisions to Title 3 of the California Code of Regulations (3 CCR) sections 6000, 6424, 6428, 6432, and 6434 pertaining to Notices of Intent; 6448-6448.2 pertaining to 1,3-dicloropropene field fumigations; 6690 and 6692 pertaining to pesticide applications near schools; and Title 16, California Code of Regulations (16 CCR) sections 1970, 1970.4, 1970.41, 1970.42, and 1970.43 pertaining to structural fumigation logs and notification requirements. Generally, formatting and outdated web address links were corrected throughout the chapters, additionally guidance was amended in a few sections as detailed below. Updates are enclosed and will be available on DPR’s website. Please advise staff and begin using the updated versions as soon as possible.

• Chapter 2, Pesticide Pre-Application Site Evaluation (PR-ENF-102)
  • Information added to Site Selection section to reference new Endangered Species requirements.
  • Amended Requirement 1 (Notice of Intent (NOI) Consistent with Permit), guidance reflects changes to 3 CCR section 6434 concerning NOI submission requirements.
• Chapter 4, Pesticide Use Monitoring Report (PR-ENF-104)
  • Clarified Requirements 1 (PCB Licensed) and 2 (PCB Registered in County), added statement when the application is made by an operator of the property, inspectors should mark the requirement as “N/A”.
  • Amended Requirement 4 (Notice of Intent (NOI) Submitted), guidance updated to reflect changes to 3 CCR section 6434 concerning NOI submission requirements.
  • Amended Requirement 36 (Pesticide Use Near Schoolsites), added language to specify starting December 31, 2026 “schoolsites” include private schools.
  • Amended Requirement 40 (Notice to Apiary Operators), changed reference to “BeeWhere” to “a notification service designated by the commissioner” as stated in regulation.
• Chapter 5, Commodity Fumigation Use Monitoring Inspection Report (PR-ENF-105)
  • Amended Requirement 4 (Notice of Intent (NOI) Submitted), guidance updated to reflect changes to 3 CCR section 6434 concerning NOI submission requirements.
  • Amended Requirement 29 (Pesticide Use Near Schoolsites), added language to specify starting December 31, 2026 “schoolsites” include private schools.
• Chapter 6, Field Fumigation Use Monitoring Inspection (PR-ENF-106)
  • Amended Requirement 6 (Notice of Intent (NOI) Submitted), guidance updated to reflect changes to 3 CCR section 6434 concerning NOI submission requirements.
  • Amended Requirement 28 (1,3-Dichloropropene Fumigation Methods), revised the date on incorporated document “1,3-Dichloropropene Field Fumigation Requirements, rev. January 1, 2026”, corrected code section from 6448.1 to 6448.2, and added language about buffer zones.
  • Amended Requirement 42 (Pesticide Use Near Schoolsites), added language to specify starting December 31, 2026 “schoolsites” include private schools.
• Chapter 7, Structural – Branch 1 Use Monitoring Inspection Report (PR-ENF-107)
  • Amended Requirement 4 (Occupants Fumigation Notice and Pesticide Disclosure Signed / Available), updated guidance to reflect changes to the Occupants Fumigation Notice and Disclosure Form 43M-48 Rev. 10/22.
  • Removed Requirements 37-40 pertaining to methyl bromide per request from the California Agricultural Commissioners and Sealers Association Technical Advisory Panel, since methyl bromide is no longer used for structural fumigations.
• Chapter 8, Structural – Branch 2/3 Use Monitoring Inspection Report (PR-ENF-108)
  • Amended Requirement 2 (Written Notice to Occupant), updated the 16 CCR section reference in guidance to the correct code section, 1970.42.
  • Amended Requirement 3 (Pesticide Post-Application Notice Requirements (Pesticide Disclosure Available), updated code section to 1970.42 and modified guidance to reflect the new requirements for the post-application pesticide notice
• Chapter 9, Pest Control Headquarters Records Inspection Report (PR-ENF-109)
  • Amended Requirement 11 (MB Recordkeeping), removed references to annual schoolsite notification since it is addressed in Requirement 37.
  • Amended Requirement 37 (Annual Notification Schoolsite), added language to specify starting December 31, 2026 “schoolsites” include private schools and updated annual notification statement to match current regulation.
• Chapter 10, Pest Control Business Headquarters Inspection Report (PR-ENF-110)
  • Amended Requirement 16 (Fumigation Log / 3 Years), updated guidance with when to mark yes, no, or N/A.
  • Updated Requirement 18 (Notice to Occupant), to correct the referenced code section number to 16 CCR section 1970.42.
