POLICY AND PROCEDURAL CHANGES in 1999

Concurrent Reviews. Effective January 1, 1999, DPR implemented concurrent review (with U.S. EPA) of certain antimicrobial products. This change was required by law and expands the types of products allowed to be submitted concurrently. Details are in California Notice 98-8.

Revised Application Form. The California Application for Pesticide Registration Form 39-030 was revised and is available on DPR's Pesticide Registration Branch homepage. Details are also in California Notice 99-4.

Pheromones (lepidopteran) data requirements. DPR will no longer require fish and wildlife data, groundwater data, or human health effects data (includes acute toxicology, chronic toxicology, and worker safety) for certain lepidopteran pheromones. The chemistry and efficacy evaluators will still review these products. For a definition of the affected lepidopteran pheromones, contact this office or your assigned DPR Registration Specialist.

Chlorine gas relabeling. Registrants are reminded that certain chlorine gas products must be relabeled as restricted materials in accordance with federal deadlines. The U.S. EPA Reregistration Eligibility Decision (RED) document for Chlorine Gas contains the required label changes and the compliance dates for the years 2000 and 2001.

Flammability label requirements for total release foggers. Total release foggers containing a propellant with a flash point at or below 20 degrees Fahrenheit must have revised labels. U.S. EPA's PR-Notice 98-6 outlines the label requirements and the 1999 compliance date for existing products.

Registration of certain devices. Registrants are reminded that devices intended to control structural wood-destroying pests require DPR registration by July 2001 or sale becomes unlawful. See DPR's home page for law text.

Reevaluation. Reevaluations of several currently registered active ingredients are underway. Included are cyfluthrin, copper naphthenate, diphacinone, propetamphos, and chlorpyrifos. Reevaluation of maneb was concluded. Reevaluation of brodifacoum was initiated. For details on the status of each reevaluation, please contact this office.

Staffing Increase. A legislator's request to the governor resulted in an increase of 11 person years of staff to the Pesticide Registration Branch. The additional personnel will help to reduce the backlog and expedite review of reduced-risk pesticides.

Proposed regulations exempting federally-exempt (Section 25b) products. DPR has proposed regulations to exempt certain federally-exempt products in California. However, until regulations are in place in California, these pesticides continue to require registration by DPR. Watch DPR's home page for revisions to the proposed regulations and deadlines for public comment.

Rescinded proposed regulations on efficacy data. Proposed regulations, which would have exempted agricultural products from submission of efficacy data, have been withdrawn.
