CALIFORNIA AUTHORIZATION FOR PESTICIDE USE UNDER U.S. EPA SECTION 18 QUARANTINE EXEMPTION FOR DISTRIBUTION AND USE ONLY WITHIN CALIFORNIA

Pursuant to authority granted under Section 18 of the Federal Insecticide, Fungicide and Rodenticide Act and 40 CFR, Part 166, approval is granted to use the pesticide shown below to control specified emergency.

Location:  Counties of San Bernardino, San Joaquin, Stanislaus, Tulare, and Yolo (only for use in California Animal Health & Food Safety laboratories and associated facilities).

Crop/Site/Commodity:  Washable, hard, non-porous surfaces (such as floors, tables, equipment, and counters), items (such as non-disposable instruments, sharps, and sharp containers), and/or laboratory waste solutions (such as formalin or other liquids).

Target Pest/Problem:  Prions (protein-based infectious particles)

Dosage:   Thoroughly mix the treatment solution until uniform. Discard treatment solution daily or when it becomes dirty and replace with a fresh solution. Remove gross filth mechanically before treatment begins.

Apply a 5-9% concentration of the Environ LpH Germicide diluted in water (7-12 ounces of product per 1 gallon of water) to washable, hard non-porous surfaces or items by mop, cloth, sponge, brush, squirt bottle, low volume coarse spray applicator, or immersion and maintain contact for at least 30 minutes. Re-treat as necessary to keep wet throughout the 30 minute time period. Following the contact time, surfaces or items may be rinsed with water and allowed to air dry.

Items may also be soaked in a 0.9% concentration of Environ LpH Germicide (1.5 ounces of product per gallon of water) for at least 16 hours. Re-treat as necessary to keep wet throughout the 16 hour time period.

For laboratory waste solutions, add Environ LpH Germicide to create a final concentration of 5-9% and allow a contact time of at least 30 minutes or add Environ LpH Germicide to create a final concentration of 0.9% and allow a contact time of at least 16 hours.

Frequency/Timing of Application:   Qualified personnel in CAHFS laboratories that handle potentially TSE-contaminated animal tissues will make applications on an as-needed basis.

Expiration Date:   March 26, 2011

Other Requirements:

  1. Environ LpH Germicide is corrosive and may cause irreversible eye damage or skin burns. It is harmful if swallowed, absorbed through the skin or inhaled. Prolonged or frequently repeated skin contact may cause allergic reaction in some individuals. The user must wear protective clothing (long sleeved shirt and long pants, socks plus shoes, and chemical resistant gloves). Goggles or face shields (safety glasses) must be worn. The user should avoid breathing spray mist and must prevent contact with eyes, skin or clothing.

All applicable directions, restrictions, and precautions on the U.S. EPA registered label for Environ LpH Germicide (EPA Reg. No. 1043-118) and these use instructions must be followed.

This labeling must be in the possession of the
user at the time of pesticide application.

The Department shall be immediately informed of any adverse effects resulting from the use of this exemption.

Please note:  The U.S. EPA expects concerned users or user groups to work towards the registration of use patterns that may be needed on a continuing basis.  It will, therefore, be necessary to require applicants wishing to renew emergency exemptions to provide a progress report on registration along with a request for re-issuance of an emergency exemption.  Without substantial progress in pursuing registration for the use in question, it will be difficult to obtain an emergency exemption for another season. 

Interim use reports must be submitted by the county agricultural commissioner to the Pesticide Registration Branch, Department of Pesticide Regulation by January 26, 2009 and January 26, 2010.  A final use report must be filed within 45 days of the expiration date of this exemption to the Pesticide Registration Branch, Department of Pesticide Regulation.  These reports must include the following information:

  1. Amount of product used..
  2. Units (i.e. sq. ft.) treated.
  3. Number of applications.
  4. Estimate of effectiveness.
  5. Any adverse effects noted.

Prior to use under this exemption, a permit must be obtained from the county agricultural commissioner.  The permit shall state the maximum number of sq. ft. to be treated, maximum amount of product that may be applied, and dealer from which the product may be purchased.  The purchaser (permittee) or purchaser’s (permittee’s) agent must provide the seller, or person delivering the restricted material, a copy of the permit on the date the restricted material is delivered.  The dealer shall maintain a record of each sale, which shall be made available to representatives of the Department of Pesticide Regulation or county agricultural commissioner upon request.  Such records shall include the date of sale or delivery, permit number, identity and amount of product purchased, and the name of the purchaser.

All applications of this material shall be made by or under the supervision of a certified applicator certified for this category of pest control. 

User’s who apply this material shall submit a pesticide use report to the county agricultural commissioner by the 10th day of the month following the month in which the applications are made.  The county agricultural commissioner in cooperation with the Department of Pesticide Regulation, will monitor the use of the product under this exemption, and will prepare a written report describing any unusual or adverse effects attributable to this use.

This exemption does not constitute a recommendation of the Department of Pesticide Regulation.  To the extent consistent with applicable law, neither the Department nor the county agricultural commissioner, manufacturer or the formulator makes any warranty of merchantability, fitness of purpose, or otherwise, expressed or implied, concerning the use of a pesticide in accordance with these provisions.  The user and/or grower acknowledge the preceding disclaimer.
